Hemp products with less than 1% THC aren’t covered by the Narcotics Act – so they aren’t regulated. However, they have to meet different regulatory requirements depending on how they’re used. There are strict rules for products containing cannabidiol (CBD) that are meant to be consumed.
While the production, sale, and use of CBD flowers, CBD oil, and other cannabis products with less than 1% THC have been established in Switzerland for many years, the current ban on cannabis with more than 1% THC for non-medical purposes hasn’t led to less use or better health protection. The Federal Council supports an evidence-based approach to cannabis policy: For legal sales, they recommend strict regulations, making sure it doesn’t lead to commercialization or encourage more use.
Around 56 tons of cannabis are consumed illegally in Switzerland every year. This shows that bans don't completely stop people from using it. Plus, bans come with downsides. When cannabis is sold on the black market, there's no way to check for harmful additives, pesticides, or even the THC content. So you never really know what you're actually using.
