General Terms and Conditions (GTC)

1. Scope of Application and Conclusion of Contract

1.1

The online shop www.greenpassion.ch is intended exclusively for private individuals (B2C). These General Terms and Conditions (GTC) therefore apply to purchase contracts with private customers concluded via the website www.greenpassion.ch.

By visiting and using our website, by placing an order on our website, and/or by confirming via email, post or telephone, you expressly declare that you have read and accepted these GTC and the Privacy Policy. By ticking the checkbox at the end of the ordering process under “Review & Order”, you confirm that you have read and accepted the applicability of the GTC and the Privacy Policy.

You agree to be bound by these GTC and the Privacy Policy and thereby enter into a contract with Green Passion GmbH, a company registered in Switzerland with its registered office in Oberglatt/ZH, UID No. CHE-156.923.503.

If you do not wish to accept these GTC and/or the Privacy Policy, you must not tick the checkbox “I have read and agree to the Terms and Conditions”, must not visit or use the website, and must not place any orders via our website.

1.2

The provider confirms receipt of the order by means of an automated order confirmation. This automatically sent email merely serves to inform you that the data has been successfully transmitted. It does not constitute a binding contract and does not yet represent acceptance of your order. Acceptance (conclusion of the contract) only takes place when the goods are dispatched by Green Passion GmbH.

2. Prices and Special Offers

2.1

Unless otherwise agreed, prices are stated in Swiss francs (CHF) and include VAT and any applicable tobacco taxes. Any VAT shown on invoices cannot be reclaimed by the buyer (B2C).

2.2

The provider reserves the right to change prices at any time. The prices stated in the order confirmation sent by email, letter or fax are decisive. If these prices exceed those valid at the time of ordering, the latter shall apply. In the event of delivery delays or procurement, the daily price on the order date shall apply.

2.3

Any conditions for promotions and discounts are available in the respective information.

3. Delivery Conditions

Attention: We currently deliver only within Switzerland and Liechtenstein.

3.1

Unless otherwise stated, delivery costs are borne by the buyer and are not included in the purchase price. The flat-rate shipping fee is CHF 7.– per order and is displayed in the shopping cart. Delivery costs are waived for orders with a minimum order value of CHF 100.–.

3.2

We can only deliver our products from Monday to Friday (excluding statutory and public holidays). Once an order has been placed, the delivery address can generally no longer be changed. If you wish to change the delivery address after placing an order, please contact us as soon as possible via the following link.

3.3

The delivery time is approximately 1–3 working days. The actual delivery date depends on product availability, the delivery address provided, and whether payment has been received.

3.4

You must inform us via the link below before the agreed delivery date if there are any circumstances relevant to delivery. This includes all access-related factors without exception: on the way to your delivery address (e.g. low bridges, narrow streets) and/or at the delivery address itself (e.g. small doors, narrow passageways, steps). Please carefully consider whether such factors apply.

3.5

You may be required to pay additional delivery charges if:

delivery cannot be completed because no person over 18 years of age is present at the delivery address on the delivery date;
you attempt to change the delivery address after the parcel has already been dispatched; and/or
you fail to inform us of special circumstances relevant to delivery.

Despite our best efforts, we cannot guarantee delivery and reserve the right, at our sole discretion, to refuse delivery of the product to a specific address within a building at the delivery location.

If your order includes goods subject to age restrictions, we ensure through a reliable procedure including personal identity and age verification that the customer has reached the required minimum age. The courier will hand over the goods only after successful age verification and only to the customer personally.

Benefits and risks pass to the customer upon delivery of the goods.

4. Right of Withdrawal / Money-Back Guarantee

4.1

Our offers are described in detail and transparently on the website www.greenpassion.ch. Customers can inform themselves thoroughly and without time pressure.

4.2

If you act as a consumer, you may revoke your contractual declaration within 14 days without stating reasons in text form (e.g. letter or email) or by returning the goods. The period begins on the day after you receive the goods. Timely dispatch of the revocation or the goods is sufficient to meet the deadline.

The revocation must be sent, stating the relevant payment details for the refund, to:

Please note that for legal reasons we cannot accept returns or issue refunds for opened or unsealed products.

4.3

Once we have received the returned goods, we will refund the purchase price. As a rule, you must bear the return shipping costs if the delivered goods correspond to those originally ordered.

5. Warranty

5.1

The buyer must inspect the delivered goods as soon as possible and report defects immediately. Hidden defects may also be reported after commissioning or use. Payment does not constitute a waiver of warranty claims.

5.2

If a defect exists, the buyer may choose between free repair, a price reduction corresponding to the reduced value, withdrawal from the contract, or replacement delivery. The buyer’s right to claim damages remains reserved in all cases.

6. Payment

6.1 Advance Payment

You may choose the “Advance Payment” option on the order form and transfer the amount in CHF to our account after order confirmation. Please transfer the amount stated in your order confirmation, quoting your order number. All fees are borne by the sender.

6.2 Purchase on Invoice (with Installment Option)

Purchase on invoice with installment option is provided by POWERPAY (MF Group) as an external payment service provider. By choosing this payment method, you also accept POWERPAY’s GTC (powerpay.ch/de/agb).

7. Liability for Online Connections

7.1 – 7.4

The provider ensures appropriate technical security, data protection compliance, and excludes liability for third-party failures, force majeure, improper use, or external interference.

8. Your Account and Password

8.1 – 8.3

You are responsible for the security of your account credentials and the accuracy of your personal data and must update them promptly if changes occur.

9. License

9.1 – 9.2

All content on greenpassion.ch is protected by copyright. Reproduction, distribution or commercial use without prior written consent is prohibited.

10. Intended Use of Goods – Customer Obligations – Liability

10.1

Where product delivery depends on intended use, the customer is liable for any disadvantages resulting from incorrect information.

Cannabis flowers are taxed as tobacco substitute products by the Swiss Federal Customs Administration (EZV). By placing an order, the buyer acknowledges that resale of tobacco substitute products at a higher price than set by Green Passion GmbH is prohibited.

11. Applicable Law and Place of Jurisdiction

11.1

For all private customers, the law of the state in which the customer has their habitual residence shall apply to these GTC.
