Planting CBD seeds: What is legal in Switzerland and what isn’t?
One fundamental thing first: Yes, you may legally buy, own and plant CBD seeds in Switzerland. However, all of this comes with a few conditions, and we’ll take a look at them together now.
First there’s the well-known 1-percent rule. It applies not only to the products that can be made from the plants, but also to the plant itself. So your CBD plants may contain a maximum of one percent THC.
How many plants you own is also decisive. Up to nine plants are legal; from ten onwards you’re already in the territory subject to reporting requirements.
These rules apply to private cultivation. If you grow commercially, there is no upper limit on the number of plants. Of course, you then have to register your project.
Here once again are the requirements for planting CBD seeds legally in Switzerland:
- THC content below one percent
- a maximum of nine plants
- EU-certified seeds
Which CBD seeds are permitted in Switzerland?
Since January 1, 2021, the FOAG variety catalogue no longer contains any hemp seeds, because the relevant provisions were repealed in Swiss seed law. Import requirements have also no longer existed since then. However, a plant passport or a phytosanitary certificate is required if you bring plants into Switzerland or if they are brought to you from abroad.
If you want to legally buy CBD seeds within Switzerland, they must be certified EU hemp seeds, even though Switzerland is not an EU country. This way you’re definitely playing it safe here, because these seeds contain a maximum of 0.3 percent THC. In this respect, the EU regulations are somewhat stricter than those in Switzerland.
CBD hemp vs. THC cannabis: The decisive differences
We’ve already touched on it: The THC content of the plants that grow from your CBD seeds must not exceed one percent. That brings us to another important point that you must not disregard under any circumstances if you want to legally plant CBD seeds in Switzerland.
The plants that form from them must necessarily be CBD hemp. THC cannabis falls under the Narcotics Act in Switzerland and is therefore prohibited. Here are the most important differences for you at a glance:
